Request Clarke County Court Records

Clarke County court records begin at the office that keeps the file you need. The Circuit Clerk holds Circuit and District case papers, while Probate Court and municipal courts keep their own. Start there. Public files can be viewed through remote access or in person at the right clerk's counter, then ordered as a plain or certified copy. A good request names the case, division, document, and format. That detail helps the clerk pull the correct Clarke County court record fast.

How to Get Court Records

Circuit Clerk Summer Scruggs Padgett holds the county's state trial court files: Circuit Civil, Circuit Criminal, District Civil, District Criminal, Small Claims, Domestic Relations, Child Support, Protection from Abuse, Traffic, Juvenile, and warrants. For remote access, Just One Look sells case-by-case searches, and Alacourt.com offers subscriptions. At the clerk's office, public dockets and filings can be viewed on screen at no charge.

Requests also work at the counter, by mail, or after a phone or fax inquiry. Mail goes to P.O. Box 921, Grove Hill, AL 36451. Call (251) 275-3163, or the separately published county line at (251) 275-3363, to confirm the division, copy price, page estimate, payment form, and release status. The fax is (251) 275-3271. No written public-record procedure can override a seal or confidentiality rule.

  1. Identify the deciding court, division, full case number, and party names.
  2. Inspect the case action summary and select the precise filed item.
  3. Choose remote viewing, free clerk-office viewing, counter pickup, or mail delivery.
  4. State whether a plain or certified copy is needed and request a quote.
  5. Pay as directed and provide postage for a mailed return.

Clarke County Court Record Requests

Clarke County publishes no local copy request form. So write your own. Include your name and contact information, mailing address if needed, the court and division, full case number, case style, the exact document, filing date or date range, certification choice, and delivery method. The Clarke County Circuit Clerk page gives the official county contact route. Skip sensitive identifiers nobody needs. The clerk may ask questions before starting.

Name the item precisely. Ask for "the signed judgment filed on the stated date" or "the case action summary," not "everything." Whole files cost more, take longer, and can hold material that cannot be released. Staff can locate a record and explain copy mechanics. They cannot interpret an order or advise which filing to make.

Strong identifierFull Alabama division-coded case number.
DocumentCase action summary, complaint, indictment, motion, order, judgment, or other named filing.
Copy formPlain or clerk-certified reproduction.

Types of Court Records

Three things get confused here. The docket, the filed document, and the certified copy are distinct. A docket is the case action summary. It runs in chronological order. Behind each entry sits the filed document itself, the pleading, notice, order, or judgment. A certified copy is a clerk-authenticated reproduction of an original that is filed or recorded. A screen image helps you track a case. But it carries no clerk authentication.

Common Clarke County court record requests include:

  • Complaints, petitions, answers, indictments, and motions
  • Signed orders, judgments, decrees, and sentencing orders
  • Case action summaries, settings, and disposition records
  • Public payment histories, writs, garnishments, and executions
  • Notices of appeal and record-transmission entries

Access varies with case type and your rights as a viewer. Domestic, juvenile-linked, adoption, youthful-offender, protection, and sealed material may be withheld or redacted.

Clarke County Court Record Custodians

The Circuit Clerk is not the only keeper of Clarke County court records. The Probate Judge holds probate-estate, guardianship, conservatorship, land, election, and other statutory probate records. Each municipal clerk controls that city's ordinance, misdemeanor, and traffic dockets. A municipal appeal opens a new Circuit Court record. But it does not drag every earlier city document into a county portal.

The official Clarke County Probate Court page shows its separate free account-based search. It also explains how to reach that office.

That probate portal is handy for probate records. It still does not replace the Circuit Clerk's state trial court file.

What a Court Record Contains

A full case file often says more than its docket line. The case action summary lays out the order of events. Pleadings state the claims, charges, or responses. Orders and judgments hold the judge's actual terms. Notices flag scheduled action. Returns report what happened with service. When a short portal label is unclear, the signed filing controls.

Case NumberUnique court identifier with a division code, year, and sequence.
PleadingsComplaint, petition, answer, indictment, motion, and related filed papers.
Orders and JudgmentsSigned directions, rulings, disposition, and final relief.
Docket SheetThe chronological case action summary of filings, settings, and outcomes.
Financial EntriesCosts, fines, payments, or balances as appropriate to the matter.

Images show up only when a document is stored electronically and stays public. No image listed? Ask the clerk for that filing by its exact title and date.

Clarke County Court Record Certification

Rule 30 of the Alabama Rules of Judicial Administration lets the clerk certify a copy only when the original has been filed or recorded with the court. The certification can carry an electronic signature and seal. For Clarke County Circuit and District documents, Summer Padgett's office is the place to get that authentication. Probate and municipal records are different. Each of those offices certifies its own papers.

What does a certified copy get you? Formal clerk authentication, which some agencies demand. A plain copy works fine for reading a Clarke County court docket or tracking your own case. Tell the clerk which document you need rather than a legal conclusion about it, and let the receiving office say what form it requires. One limit worth knowing: the clerk cannot certify what you print from a docket search result.

Three separate objects: A docket indexes events, a filed document contains the text, and a certified copy authenticates an original on file.

Certified Copies and Fees

Clarke County publishes no current local price for copies, searches, or certification. Borrowing another Alabama county's schedule would mislead you. Rule 30 allows fees set under an Administrative Director directive. It permits prepayment before release. Postage is left to the requester. Confirm the exact quote and accepted payment with the Clarke County Circuit Clerk before sending any funds.

ItemCurrent Governing Information

Just One LookPaid case-by-case; confirm the current price on the transaction screen.

CertificationAvailable for an original on file; confirm the local charge.
PostagePaid by the requester.

Rule 30 lets parties, attorneys, and government offices receive discretionary no-charge copies, but that is not a general waiver. Ask the clerk whether the provision applies before counting on it.

Clarke County Court Record Postage

Rule 30 puts postage on you when you mail a records request. Include a self-addressed stamped envelope, or arrange whatever delivery the clerk directs. Add a phone number or email too. Staff can then confirm the document. They can give you a page count and explain payment before releasing the copy.

Big or archived files deserve a quick call first. Ask whether electronic delivery is an option. Ask whether certification changes the handling, and whether an archive search charge applies. Clarke County publishes no fixed response time for mailed requests. A precise written request still helps, since vague ones move slowly.

Public Access and Sealed Records

Alabama's 2025 Rules of Court-Record Privacy and Confidentiality keep clerk-office viewing free. Anyone may read the public electronic docket. Court records are open at the office too. Rule 33 also preserves inspection and paid printing at circuit clerks. The authority is Alabama Code section 36-12-40. Those rights bend to redaction, sealing, and case-specific confidentiality rules.

Juvenile, adoption, expunged, and youthful-offender files are different animals entirely. Ask the clerk whether a redacted public copy exists and what authority backs any denial. A judge's seal cannot be waived. No general public-record request forces staff to open a protected record.

Key Rules:

Alabama Rules of Court-Record Privacy and Confidentiality provide the main statewide access and privacy framework.

Alabama Rule of Judicial Administration 30 governs copies, payment, and certification.

Alabama Code public-record provisions preserve inspection rights subject to lawful limits.

Clarke County Court Record Law

Court rules govern court files and AOC data directly. The statutes sit around them, and the official code article carries the full public-record language of the Code of Alabama for anyone who wants the statutory text itself.

Start with the court rule and the clerk holding the original whenever you need a filed pleading or judgment. A general records statute never overrides case confidentiality.

Clarke County Archived Court Records

An older Clarke County file may live on paper, microfilm, or a shelf in storage. The current docket system may be electronic. Give the clerk the names, the likely year, the division, and any known case number. Retrieval takes time. An archive-search fee may apply, so ask before ordering a whole file. No official Clarke County fee schedule posts an amount.

Ask to inspect the case action summary first. It pins down the exact judgment, order, or filing date and shrinks your page count. The Clarke County case search supplies the name, number, division, and result fields that narrow a record order.

Clarke County Probate Record Copies

Probate copies come from the Clarke County Probate Judge, not the Circuit Clerk. The Probate Court sits in the same 114 Court Street complex, yet it uses P.O. Box 10 and (251) 275-3251. One shared street address hides a major custody split. Estates, guardianships, conservatorships, and other statutory probate business all follow the probate route.

The free probate account portal may display documents. Certification and any restricted record still rest with the Probate custodian. Ask that office for its current copy terms. Grove Hill houses both courts. That is no reason to send a probate request to the state trial case system.

Clarke County Municipal Court Records

Every active municipal court keeps its own records. Boundaries and population decide which cities qualify. The Census incorporated-place inventory lists the official places that shape the county's city framework.

That inventory explains custody, not cases. It shows why Jackson, Thomasville, Grove Hill, Coffeeville, and Fulton may hold municipal records. Those sit apart from Clarke County state courts.

Ask the deciding court for a city disposition on any citation or ordinance case. An appeal for trial de novo creates a separate Circuit record. Get that one too, and keep both case numbers.
